Public Records Request (Police)
PUBLIC RECORD REQUEST PROCEDURES:
All Public Record Requests must be made in writing. It is our policy to respond to Public Record Requests in an orderly, consistent and reasonable manner in accordance with Oregon Public Records Law. Once your request has been received, you will receive an email response within five (5) business days acknowledging receipt of your request (ORS 192.324(2)). Each request is reviewed on a case-by-case basis. Information released will be reviewed and redacted per applicable State and Federal laws. Please do not submit a second request for the same record(s). If you request a record which is exempt from public disclosure (ORS 192.345), you will be notified. For example:
- Records related to open cases that have criminal charges pending and / or are active criminal investigations are conditionally exempt from release by our agency until adjudicated by a Court or the case is otherwise closed.
- Officers’ body worn camera (BWC) footage is conditionally exempt from release. ORS 192.345(40) states: “audio or video recordings, whether digital or analog, resulting from a law enforcement officer’s operation of a video camera worn upon the officer’s person [e.g. BWC] that records the officer’s interactions with members of the public while the Officer is on duty” are exempt from disclosure unless the public interest requires disclosure in the particular instance. Public interest means the interest to the public at large, not a particular person at a particular time. The requestor has the burden to demonstrate that the release is in the public’s interest.
Additionally, under Oregon Public Records law there are exceptions that restrict the release of some records deemed confidential or sensitive, or as exempt from public disclosure by our agency either permanently, or for a period of time. Examples of confidential information and / or exempt records that will not be disclosed include (but are not limited to) elder or child abuse, juvenile information, records referred to Department of Human Services (DHS), Oregon Juvenile Department, physical and certain personal information including mental health information.
If the record(s) you requested is available and releasable, you will be notified as pre-payment is required before the record will be prepared for release. Payments can be made Monday through Friday, 9am - 4pm in person at the Police Department Records Counter or, if using a credit / debit card, by phone at (503) 266-1104, Opt. 0. Once your payment has been made, the report will be prepared for pick-up or mailing, which may take up to an additional ten business days (ORS 192.329).
