Public Record Request Procedure

 

All Public Record Requests must be made in writing.  It is our policy to respond to Public Record Requests in an orderly, consistent and reasonable manner in accordance with Oregon Public Records Law.  Once your request has been received, you will receive an email response within five (5) business days acknowledging receipt of your request. Each request is reviewed on a case-by-case basis. Information released will be reviewed and redacted per applicable state and federal laws. Please do not submit a second request for the same record(s). 

If you are requesting a record which is exempt from public disclosure, you will be notified.  Records related to cases that have criminal arrests pending or are still under investigation are exempt from release by our agency (ORS 192.345). Additionally, under Oregon Public Records law there are exceptions under the law that restrict the release of some records deemed confidential or sensitive, or as exempt from public disclosure by our agency either permanently, or for a period of time.  Examples of confidential information and / or exempt records that will not be disclosed include (but are not limited to) elder or child abuse, juvenile information, records referred to Department of Human Services (DHS) or the Oregon Juvenile Department, physical and certain personal information including mental health information.  

If the record(s) you requested is available and releasable, you will be notified as pre-payment is required before the record will be prepared for release.  Payments can be made at the Police Department Records Counter during regular business hours (Monday thru Friday, 9 am until 4 pm) or, if using a credit / debit card, by phone at (503) 266-1104, Opt. 0.  You will need to provide the Records Clerk with the report number(s).  Once your payment has been made, the report will be prepared for pick-up or mailing, which may take up to an additional ten business days.

Please provide as much information as you can. Note: Under ORS 192.311 to 192.478, some public records or specific information contained in a released report, may be exempt from disclosure.
Note: HB 3464 prohibits agencies from disclosing certain information if it is for the purpose of enforcement of federal immigration law (unless disclosure is otherwise required by state or federal law.)
